सूचना का अधिकार (Right to Information Act)
सूचना का अधिकार (Right to Information Act): सरकारी पैसा,कामकाज और सूचना पाना जो पहले कभी ना-मुमकिन हुआ करता था आज हर आदमी के बस की बात हो चुका है.
इस अधिकार को ना केवल आम आदमी बल्कि गरीबी की रेखा के नीचे रहने वाल हर शख्स कर स्कता है और अपने हक के बारे में जानकारी और आँकड़े जुटा सकता है.
लेकिन उससे भी ज्यादा जरूरी होता है इस अधिकार को जन-साधारण त पहुँचाने और उनको उनके अधिकारों के बारे में इंगित करने की.तो आइये पहले हम खुद ही इस बारें में पता लगाते हैं कि क्या है ये सूचना का अधिकार और कैसे ये आम आदमी का अधिकार है
सूचना का अधिकार अधिनियम, 2005
सूचना का अधिकार अधिनियम (Right to Information Act) भारत के संसद द्वारा पारित एक कानून है जो 12 अक्तूबर, 2005 को लागू हुआ (15 जून, 2005 को इसके कानून बनने के 120 वें दिन)। भारत में भ्रटाचार को रोकने और समाप्त करने के लिये इसे बहुत ही प्रभावी कदम बताया जाता है। इस नियम के द्वारा भारत के सभी नागरिकों को सरकारी रेकार्डों और प्रपत्रों में दर्ज सूचना को देखने और उसे प्राप्त करने का अधिकार प्रदान किया गया है। जम्मू एवं काश्मीर को छोडकर भारत के सभी भागों में यह अधिनियम लागू है।
सूचनाऍ कहाँ से मिलेगी ?
-केन्द्र सरकार,राज्य सरकार व स्थानीय प्रशासन के हर कार्यालय में लोक सूचना अधिकारियों को नामित किया गया है।
-लोक सूचना अधिकारी की जिम्मेदारी है कि वह जनता को सूचना उपलब्ध कराएं एवं आवेदन लिखने में उसकी मदद करें.
कौन सी सूचनाऍ नही मिलेंगी ?
-जो भारत की प्रभुता, अखण्डता, सुरक्षा, वैज्ञानिक या आर्थिक हितों व विदेशी संबंधों के लिए घातक हो.
-जिससे आपराधिक जाँच पड़ताल,अपराधियों की गिरफ्तारी या उन पर मुकदमा चलाने में रुकावट पैदा हो.
-जिससे किसी व्यक्ति के जीवन या शारीरिक सुरक्षा खतरे में पड
-जिससे किसी व्यक्ति के निजी जिन्दगी में दखल-अंदाजी हो और उसका जनहीत से कोई लेना देना ना हो.
स्वयं प्रकाशित की जाने वाली सूचनाऍ कौन सी है ?
-हर सरकारी कार्यालय की यह जिम्मेदारी है कि वह अपने विभाग के विषय में निम्नलिखित सूचनाऍ जनता को स्वयं दें
-अपने विभाग के कार्यो और कर्तव्यों का विवरण ।
-अधिकारी एवं कर्मचारियों के नाम, शक्तियाँ एवं वेतन ।
-विभाग के दस्तावेजों की सूची ।
-विभाग का बजट एवं खर्च की व्यौरा ।
-लाभार्थियों की सूची, रियायतें और परमिट लेने वालों का व्यौरा।
-लोक सूचना अधिकारी का नाम व पता
सूचना पाने की प्रक्रिया क्या है?
-सूचना पाने के लिए सरकारी कार्यालय में नियुक्त लोक सूचना अधिकारी के पास आवेदन जमा करें । आवेदन पत्र जमा करने की पावती जरुर लें ।
-आवेदन पत्र के साथ निर्धारित फीस देना जरुरी है ।
-प्रतिलिपि/नमूना इत्यादि के रुप मे सूचना पाने के लिए निर्धारित शुल्क देना जरुरी है
सूचना देने की अवधि क्या है ?
सूचनाऍ निर्धारित समय में प्राप्त होंगी
-साधारण समस्या से संबंधित आवेदन 30 दिन
-जीवन/स्वतंत्रता से संबंधित आवेदन 48 घंटे
-तृतीय पक्ष 40 दिन
-मानव अधिकार के हनन संबंधित आवेदन 45 दिन
सूचना पाने के लिए आवेदन कैसे बनाऍ ?
-लोक सूचना अधिकारी, विभाग का नाम एवं पता ।
-आवेदक का नाम एवं पता ।
-चाही गई जानकारी का विषय ।
-चाही गई जानकारी की अवधि ।
-चाही गई जानकारी का सम्पू्र्ण विवरण ।
-जानकारी कैसे प्राप्त करना चाहेंगे-प्रतिलिपि /नमूना/लिखित/निरिक्षण ।
-गरीबी रेखा के नीचे आने वाले आवेदक सबूत लगाएं ।
-आवेदन शुल्क का व्यौरा-नकद, बैंक ड्राफ्ट, बैंकर्स चैक या पोस्टल ऑडर ।
-आवेदक के हस्ताक्षर, दिनांक ।
सूचना न मिलने पर क्या करे ?
-यदि आपको समय सीमा में सूचना नहीं मिलती है, तब आप अपनी पहली अपील विभाग के अपीलीय अधिकारी को, सूचना न मिलने के 30 दिनों के अन्दर , कर सकते हैं ।
-निर्धारित समय सीमा में सूचना न मिलने पर आप राज्य या केन्द्रीय सूचना आयोग को सीधा शिकायत भी कर सकते हैं ।
-अगर आप पहली अपील से असंतुष्ट है तब आप दूसरी अपील के फैसले के 90 दिनों के अन्दर राज्य या केन्द्रीय सूचना आयोग को कर सकते हैं ।
सूचना न देने पर क्या सजा है ?
लोक सूचना अधिकारी आवेदन लेने से इंकार करता है, सूचना देने से मना करता है या जानबुझकर गलत सूचना देता है तो उस पर प्रतिदिन रु. 250 के हिसाब से व कुल रु. 25,000 तक का जुर्माना लगाया जा सकता है
अपील कैसे करे ?
-अपीलीय अधिकारी, विभाग का नाम एव पता।
-लोक सूचना अधिकारी जिसके विरुद्ध अपील कर रहे हैं उसका नाम व पता ।
-आदेश का विवरण जिसके विरुद्ध अपील कर रहे हैं ।
-अपील का विषय एवं विवरण ।
-अपीलीय अधिकारी से किस तरह की मदद चाहते हैं ।
-किस आधार पर मदद चाहते हैं ।
-अपीलार्थी का नाम, हस्ताक्षर एवं पता ।
-आदेश , फीस, आवेदन से संबंधित सारे कागजात की प्रतिलिपि

रिकार्ड निरिक्षण का शुल्क पहला घंटा -नि.शुल्क, तत्पश्चात हर घंटे के लिए रु. 5/-
अदायगी नकद / बैंक ड्राफ्ट / बैंकर्स चैक / पोस्टल आडर्र के रुप में
नोट: गरीबी रेखा से नीचे रहने वालों को कोई शुल्क नही देना पड़ता हैं
